These Terms govern access to and use of the Coast To Coast mobile application, web administration portal, associated databases, reports, notifications and enabled services (collectively, the App). The App is operated by Coast To Coast Converters Australia Pty Ltd (ABN 13 628 179 162) of 21-23 Phillip Street, Kingswood NSW 2747, Australia (C2C, we, us or our).
The first release is for approved C2C staff. C2C may later enable access for approved contractors, customers, suppliers or authorised representatives. Additional role-specific or transaction terms apply only when the relevant feature is enabled and the user separately accepts those terms.
These Terms supplement, and do not replace, an employment agreement, contractor agreement, confidentiality agreement, workplace policy or other binding arrangement. If there is an inconsistency, the more specific lawful term applies to the relevant subject matter.
Applicable Law means all Commonwealth, state and territory laws, regulations, binding codes and lawful directions applicable to C2C, the App, the user or a transaction.
Authorised User means a person whose individual account has been created or approved by C2C and who remains authorised to use the App.
C2C Information means App content and C2C business information, including converter photographs, serial-number mappings, grades, assays, prices, formulas, reports, customer and supplier records, bank information, notes, workflows, designs, software and database content. Where C2C Information is Personal Information, access and use are also subject to privacy law and the Privacy Policy.
Personal Information has the meaning given by applicable Australian privacy law.
RCTI means a recipient-created tax invoice.
Staff User includes an employee, officer or approved salesperson using the App for C2C work.
Transaction Feature means a feature for offers, purchases, payments, RCTIs, receipts, account credit or Xero integration. Transaction Features are not part of the initial staff release unless C2C expressly activates them.
User means an Authorised User.
Before using the App, a user must accept these Terms and any applicable role-specific policy and must acknowledge that the Privacy Policy and relevant collection notices have been provided. Acceptance or acknowledgement may occur in the App or through a separate written or electronic record approved by C2C.
C2C will record the user or account, each document name and version, and the date and time of acceptance or acknowledgement. C2C may retain and rely on those records as evidence.
A materially updated version may require renewed acceptance or acknowledgement before further use. Continued access may be suspended until the required record is completed. Changes apply prospectively and do not retrospectively alter an agreed transaction or accrued legal right except where law requires.
A user who does not agree must not use the App and must notify C2C so access can be disabled.
Acknowledging the Privacy Policy does not amount to blanket consent. C2C will seek separate consent or permission where a specific feature or law requires it, including optional marketing and any future location-tracking function.
Access is by C2C approval only. There is no automatic right to obtain or retain an account.
A person who buys, sells, approves or finalises a transaction through an enabled Transaction Feature must be at least 18 years old and have authority to act for the relevant person or business.
A user must provide accurate account and authority information and promptly notify C2C if their role, authority, employment or engagement changes.
Each account is personal to the Authorised User. Account sharing, credential sharing, impersonation and permitting another person to use an account are prohibited.
The user must protect passwords, one-time codes, authentication methods and devices, use any required multifactor authentication, and report suspected compromise immediately.
C2C may require password resets, additional verification, approved devices, updated software or other reasonable security steps.
C2C assigns permissions according to role and business need. A user may access only the information and functions made available to that role and must not attempt to bypass a restriction.
C2C may add, remove or change permissions where reasonably required to protect information, respond to a role change or security risk, or comply with law.
Access to the App does not authorise a user to bind C2C, approve a payment, change a price, disclose information or represent C2C beyond the authority separately given to that user.
A Staff User may use the App only for authorised C2C work, in accordance with lawful instructions, training, policies and approved workflows.
Users must take reasonable care when entering, reviewing, grading, approving or relying on information and must correct or report known errors.
Users must comply with Applicable Law, including privacy, employment, tax, scrap-metal, recordkeeping and lawful-source requirements relevant to their role.
Users must not interact with the App while driving, operating machinery or performing another task where App use would be unsafe or unlawful. Stop in a safe place before using the App.
The App does not replace workplace training, work health and safety procedures, physical inspection, professional judgment or an emergency process.
Unless expressly authorised in writing, a user must not copy, screenshot, screen-record, photograph, download, export, print, forward or reproduce C2C Information; scrape, crawl, harvest, enumerate or reconstruct the database; use scripts, bots or automated queries; reverse engineer, decompile or attempt to discover source code, formulas or security controls; bypass permissions or rate limits; introduce malicious code; interfere with the App; use C2C Information for another employer, business or competing service; upload C2C Information to an unapproved AI or coding-assistant system; or use C2C Information to train, benchmark or improve an external model, database or pricing service.
A user must not send C2C Information to personal email, store it in personal cloud storage, transfer it to an unapproved device or application, publish it on social media, or disclose it to an unauthorised person.
Nothing in this clause prevents a disclosure protected or required by law, including a lawful report to a regulator, law-enforcement agency, lawyer, union representative or under applicable whistleblower law.
Staff Users must comply with the separate Staff App Use, Security and Confidentiality Policy issued by C2C and any later lawful workplace direction.
These Terms do not reduce minimum employment entitlements, work health and safety protections, lawful workplace rights or any right that cannot lawfully be excluded.
Misuse may result in suspension of App access and may also be dealt with under applicable employment or disciplinary processes, subject to law and procedural fairness.
The App may be used only on a company-issued or specifically approved device. Personal-device use requires prior C2C approval and compliance with security, confidentiality and deletion requirements.
A user must use a strong device passcode and automatic screen lock, keep the operating system and App updated, prevent unauthorised physical access, use approved networks where practicable, protect lock-screen notifications and promptly report a lost or stolen device.
The App must not be used on a rooted, jailbroken or otherwise materially compromised device, or on a device running unsupported security software, unless C2C approves a documented exception.
C2C may disable accounts, revoke sessions and, for company-owned or appropriately managed devices, remotely lock or remove company information where technically available and lawful.
For a personal device, C2C may block the account and remove C2C App data where technically available and agreed, but will not intentionally erase unrelated personal data without separate lawful authority.
The App depends on information supplied by users, customers, suppliers, third parties and system providers. Users must not knowingly enter false, incomplete, misleading or outdated information.
A user must not treat an automated display, historical record, photograph, serial number or suggested match as a substitute for required physical inspection, professional judgment or approval.
C2C may correct records, preserve audit history and investigate discrepancies. A correction must not be used to conceal misconduct or alter an agreed outcome without a lawful and documented reason.
Where a material record is corrected, the system or approved process should preserve the original value, corrected value, user, time and reason, unless law requires a different treatment.
Customer and supplier information may be accessed only for authorised work and only to the extent required for that work.
Bank details may be entered only through approved fields and workflows. Full bank details may be viewed or changed only by authorised management or accounts personnel. Other roles must receive masked or no access.
New or changed bank details must be independently verified using previously verified contact information before payment. The person entering or requesting a change must not be the sole approver of the resulting payment.
Users must not place bank details in free-text notes, notifications, screenshots, email subjects or other locations not approved for secure banking information.
Any unexpected bank-change request, payment redirection, suspicious email or mismatch must be escalated before a payment is approved.
Converter photographs, serial-number records, classifications, grades, weights, assays and related notes are C2C business records.
A photograph or serial-number match may be incomplete, ambiguous or wrong. Converters with similar appearances or identifiers may have different contents, values or conditions.
A user must follow C2C inspection and grading procedures and must report suspected counterfeit, substituted, empty, partly empty, damaged, altered, contaminated, stolen or unlawfully obtained material.
Unless C2C expressly confirms a final purchase price, a price displayed in the App is indicative only.
A value may change because of identification, condition, fullness, classification, weight, precious-metal content, assay results, market prices, exchange rates, refinery terms, treatment charges, recovery rates, system inputs, stale information or administrative error.
C2C may inspect, regrade, reclassify, reject or adjust material that is incorrectly identified, damaged, empty, altered, contaminated, counterfeit, substituted or materially misrepresented. Any adjustment should be based on a genuine documented reason and Applicable Law.
Market prices, exchange rates, recovery rates and other pricing inputs may be manual, delayed or sourced from third parties. Users must check the displayed source and update time where provided and follow C2C approval rules before relying on an amount.
Booking, calendar and reminder information is an operational aid. Users remain responsible for checking assigned work, customer details, dates and changes.
A reminder or notification may be delayed or fail because of device settings, connectivity or third-party services. Users must follow C2C backup communication and scheduling procedures.
Transaction Features, including RCTIs, invoices, receipts, payment records and Xero integration, apply only when C2C enables them and the relevant user accepts any additional terms.
Until enabled, the App must not be treated as issuing an RCTI, approving a payment, creating an accounting entry or finalising a purchase.
The separate Future Customer, Supplier and Transaction Terms issued by C2C apply when the relevant function is enabled. Accountant-approved tax and document workflows prevail over any inconsistent generic description.
C2C may send operational messages reasonably required for App use, security, bookings, account administration, legal notices, purchase documents or service changes.
Marketing or promotional communications will be sent only where permitted and will include an available method to unsubscribe where required. Opting out of marketing does not prevent necessary operational, security or legal communications.
As between C2C and the user, C2C owns or licenses the App, C2C branding, database structure, compilations, business records, reports, workflows, formulas and other C2C content, subject to any rights that cannot lawfully be assigned.
C2C grants each Authorised User a limited, revocable, non-transferable right to use the App for authorised purposes while access remains approved.
No ownership or other right is transferred to a user. Restrictions on copying, reverse engineering, extraction and competing use continue after access ends.
A user must have authority to upload or enter information and must not infringe another person's rights.
To the extent the user has relevant rights or authority, the user grants C2C a non-exclusive, worldwide, royalty-free licence to store, host, reproduce, adapt, analyse, combine and use authorised uploaded material for App operation, transactions, records, compliance, security, database improvement and C2C business continuity. The licence continues for records lawfully retained after access ends.
Personal Information remains subject to the Privacy Policy and Applicable Law. This clause does not permit unrelated use of Personal Information.
The user must not upload material containing unnecessary personal information, confidential third-party material or a person's image unless the collection and use are authorised and reasonably required.
A user must keep C2C Information confidential and use it only for an authorised purpose. This obligation continues after employment, engagement or access ends.
Confidential information does not include information that is lawfully public through no breach, independently developed without use of C2C Information, or lawfully received without restriction.
Where disclosure is legally required, the user should notify C2C beforehand where lawful and disclose only what is required.
C2C handles Personal Information in accordance with the separate Privacy Policy and Applicable Law.
Users must comply with privacy instructions and must not access, use or disclose Personal Information merely because the App technically permits access.
Privacy or security concerns must be reported promptly to C2C.
C2C may use approved service providers including AWS, Firebase, Google Maps, Google Workspace/SMTP, Apple, Google Play and authorised developers. Access must be limited to the minimum information reasonably required for hosting, mapping, notifications, email, distribution, maintenance, security or support and subject to applicable confidentiality and security controls.
Authorised Supportsoft personnel in India may access application files and associated data when required for approved development, maintenance or support and while C2C permits that access.
A new provider, SDK, processing country, permission or materially different data use must not be introduced into production without C2C approval, appropriate assessment and any required update to notices and store disclosures.
The current release uses Google Maps to capture or validate addresses. A validated address may be stored. It is not configured to maintain continuous or background employee-location tracking or a separate history of precise GPS coordinates.
C2C does not use GPS/EXIF location metadata in uploaded converter photos for employee tracking. The production App must remove location metadata during upload unless C2C separately authorises a documented lawful use.
Camera, selected-photo, address/maps and notification permissions should be requested only when relevant. A user may manage optional permissions through device settings, but a related feature may not work without permission.
If C2C later introduces employee location tracking while the App is open or in the background, it will complete a jurisdiction-specific workplace-surveillance review and provide any required consultation and notice before activation. Acceptance of these Terms is not a substitute for that process.
C2C may record logins, access, changes, approvals, security events and other App activity for security, operational, compliance and dispute purposes.
Monitoring will be limited to authorised purposes, conducted subject to Applicable Law and any required consultation or workplace-surveillance notice, and will not be covert unless specifically authorised by law.
A user must not alter, conceal or interfere with an audit record or security log.
The App may be unavailable because of maintenance, updates, connectivity, device failure, cyber incidents, third-party outages or other events.
C2C may suspend or change a feature, role, permission, workflow or integration where reasonably required for security, compliance, operational continuity or a legitimate business need. C2C will not use this right to retrospectively change an agreed transaction. Material legal changes will receive appropriate notice and may require renewed acceptance.
C2C will take reasonable steps to correct material errors but does not promise uninterrupted or error-free operation.
C2C may immediately suspend or restrict access where reasonably necessary for security, suspected fraud, unlawful activity, account sharing, confidentiality breach, unauthorised extraction, role change, employment or engagement ending, or breach of these Terms.
C2C may terminate access where the user no longer has an authorised business need, subject to applicable employment or contractual rights.
Suspension or termination does not remove obligations relating to confidentiality, intellectual property, records, return/deletion, payment, investigation or liability.
When access ends, the user must stop using the App, return company devices and records, delete unauthorised copies and cooperate with session revocation and device offboarding.
C2C may retain records where required or reasonably needed for legal, employment, accounting, security, transaction, dispute or compliance purposes. Information no longer required should be deleted or de-identified in accordance with the Privacy Policy.
Account deletion may initially disable or soft-delete an account while required records are retained. C2C distinguishes account deactivation, soft deletion and permanent deletion or de-identification.
To the extent permitted by law, the App and its information are provided for authorised operational use and may contain errors or omissions. Users must apply required verification and professional judgment.
C2C does not guarantee that a photograph, serial number, suggested match, grade, market input, notification, third-party service or indicative price will be complete, current or correct in every case.
The App is not legal, tax, accounting, financial, investment, engineering or safety advice and must not be relied on as a substitute for advice or approval required for a particular decision.
Nothing in these Terms excludes a guarantee, right or remedy that cannot lawfully be excluded.
To the maximum extent permitted by law, and subject to any employment, consumer or other mandatory right, C2C is not liable for indirect or consequential business loss arising solely from App downtime, an external service failure, a user's failure to follow required checks, or unauthorised use caused by that user's serious breach of security obligations.
C2C does not exclude liability to the extent it cannot lawfully be excluded, including applicable liability for fraud, wilful misconduct, personal injury or non-excludable statutory rights.
For Staff Users, these Terms do not limit wages, leave, workplace rights, workers compensation, work health and safety rights or other minimum employment entitlements.
A user is responsible for their own fraud, deliberate unlawful conduct, material false statement, knowing involvement with stolen material, unauthorised disclosure, infringement, malicious interference or other serious misconduct.
C2C may seek recovery only to the extent permitted by law and only for loss directly caused by that conduct, reduced to the extent C2C or another person caused or contributed to the loss. Nothing authorises an unlawful wage deduction or removes a workplace, workers compensation or other mandatory right.
A user should first raise an App complaint with C2C at shannon@coast2coastconverters.com and provide enough information for investigation.
C2C will seek to investigate and respond within a reasonable period. This process does not prevent a person exercising a right to contact a regulator, tribunal, court, union, lawyer or law-enforcement agency.
The parties should attempt good-faith resolution before commencing proceedings where reasonable, except for urgent relief, recovery of stolen property, security incidents or matters where delay would cause prejudice.
These Terms are governed by the laws of New South Wales, Australia, where legally permitted. Courts and tribunals with jurisdiction in New South Wales may hear disputes, subject to any mandatory right to bring a matter elsewhere.
Australia-wide mandatory Commonwealth, state and territory laws continue to apply.
If a provision is invalid or unenforceable, it is read down or severed to the minimum extent necessary without affecting the remaining provisions.
A failure or delay to enforce a right is not a waiver. A waiver must be in writing.
C2C may assign or transfer these Terms as part of a lawful business sale, restructure or transfer of the App. A user may not transfer an account or rights under these Terms.
A notice may be given through the App, to the user's registered work email, or by another recorded method. A user must keep contact details current. Any mandatory notice rule prevails.
For a non-employee user, App access does not create an employment relationship, partnership, joint venture, fiduciary relationship or authority to bind C2C.
Headings are for convenience. Words such as including are not limiting. A reference to law includes amendments and replacements.
